PoolPay SMS Terms of Service

These SMS Terms of Service ("SMS Terms") govern your use of text messaging ("SMS") provided by PoolPay ("PoolPay," "we," "our," or "us"). By opting in or providing your mobile number, you agree to these SMS Terms.

PoolPay uses text messaging for transactional notifications, account-related alerts, and business communications, including sales and account-representative follow-ups.


1. Program Description

PoolPay operates two types of SMS programs under one brand:

1.1 Transactional & Account-Related Messages

Messages related to:

  • invoice notifications
  • payment reminders
  • verification codes
  • account alerts
  • security updates
  • service confirmations
  • billing or service issues

These messages are automated and sent as part of your use of the PoolPay platform.

1.2 Business Communications (Sales & Account Representative Messaging)

These messages may include:

  • follow-ups from your assigned PoolPay account representative
  • onboarding assistance
  • customer-support responses
  • sales or product-information messages
  • vendor or partner communication
  • appointment or meeting coordination

These messages may be manually sent by a human or sent through an A2P-compliant system such as RingCentral.


2. Message Frequency

Message frequency varies based on your activity and interactions with PoolPay. You may receive:

  • several transactional messages per billing cycle
  • periodic messages from sales or account representatives

You will not receive marketing SMS without consent.


3. How to Opt In

You may opt in by:

  • providing your mobile number to PoolPay
  • submitting a form or account signup
  • paying an invoice through a PoolPay-hosted link
  • checking a consent box
  • replying YES, START, or equivalent opt-in keyword
  • giving your number verbally or via text to a PoolPay representative
  • engaging in a texting conversation with a PoolPay representative

By opting in, you consent to receive automated and human-sent messages to the number provided.


4. How to Opt Out

You may opt out at any time by replying:

STOP

You will receive a confirmation message and will no longer receive SMS from PoolPay unless you opt in again.

6. Message & Data Rates

Message and data rates may apply. PoolPay is not responsible for carrier charges.


7. Carrier Liability

Carriers are not liable for delayed or undelivered messages.

Delivery depends on your mobile carrier.


8. Consent Representations (for Pool Pros Entering Customer Phone Numbers)

If you use PoolPay to upload or contact your customers:

You represent and warrant that:

  • you have valid consent to message each customer
  • customers understand they may receive billing and service-related notifications
  • the phone number provided belongs to the customer
  • you will immediately honor any customer request to stop messages

You are responsible for complying with all applicable SMS consent laws when entering customer data.


9. Privacy

Information provided through SMS is handled according to the PoolPay Privacy Policy.

PoolPay does not sell personal data or phone numbers.


10. Changes to SMS Terms

We may update these SMS Terms from time to time. The "Last Updated" date reflects changes. Use of the SMS program after changes constitutes acceptance.
